A prenuptial or premarital agreement is “an agreement between prospective spouses made in contemplation of marriage to be effective upon marriage.” Florida Statute 61.079 governs premarital agreements. And it tells us that in Florida we can contract related to the property during a marriage –

- transfer property,
- the obligations of each party related to that property,
- the disposition of the property if the parties separate and
- more.
